Residential Conveyancing Fees and Costs

We believe our fees and costs should be clear and easy to understand.


Our Fees and Costs

We usually carry out residential conveyancing work for a fixed fee, which will be provided in a quotation setting out our legal fees and the additional costs we pay on your behalf and VAT payable.


The total cost of conveyancing work is made up of:


  1. The fees for our work (which are subject to VAT at 20 per cent)


   2. Costs are paid by us to third parties on your behalf


   3. Stamp Duty that we pay on your behalf to the HMRC.


Costs (expenses and disbursements)


Costs are payments we make to third parties on your behalf. These are two types of costs, expenses and disbursements. An expenses is a service or good purchased from a third party by us so that we are able to carry out legal work for you. Expenses will incur VAT. A disbursement is a cost addresses to you as a client. A disbursement may incur VAT, but we will not add VAT if it does not.


The costs in residential conveyancing matters will usually include:


  1. Fees paid to HM Land Registry for copies of the documents of ownership of the property:


   2. A fee for searches of the Local Authority:


   3. Fees for bankruptcy searches:


   4. Fees charges by our bank for electronic money transfers.


Fixed Fee with No Hidden costs


Our fixed legal fees for conveyancing transactions will be set out fully when you instruct us, and that means there will be no hidden extra charges added on the end of the transaction.


We would never increase our fees for the scope of the work for which you have been quoted. If unforeseen complications or aspects of the transaction we were not told about emerge as your matter progresses, which requires additional work not included in a standard conveyancing transaction, we will tell you and set out the fixed additional fee for that extra work.


What we will do


If we are acting for the buyer, the scope of our work for standard conveyancing will be to:


  1. Carry our property searches:
  2. Review title documents:
  3. Raise enquiries with the seller's lawyers
  4. Review replies to enquiries
  5. Amend and approve the contract and transfer document
  6. Prepare a report on title;
  7. Arrange the exchange of contracts with the seller's lawyers:
  8. Submit SDLT forms and payment to the HMRC
  9. Register the purchase with the Land Registry


If we acting for the seller, we will:


  1. Check the title register and plan;
  2. Review the Law Society Forms;
  3. Create and send draft contract documents;
  4. Reply to enquiries;
  5. Review the contract and transfer deed;
  6. Proceed to exchange of contracts;
  7. Draft a Completion Statement;
  8. Deal with completion of the sale


How Long will it will take


In property transactions, it is very difficult to provide a precise timescale. There are several factors that can potentially delay conveyancing. As your matter proceeds you will be updated with more precise anticipated timescales and if there are factors preventing us from completing your matter within this timescale, we will advise you as soon as they become apparent to us.


With respect to a freehold transaction we would usually anticipate exchange of contracts on average to be 6 to 8 weeks from the issue of contracts. This can vary according to the individual transactions. Completion usually takes place 5 to 10 days after exchange.


In respect to a leasehold transactions, due to the involvement of management companies and landlords, an additional time of 3 weeks is requested giving an average of 12 to 14 weeks from the receipt of contracts.

Uncontested Probate Fees and Costs

We believe our fees and costs should be clear and easy to understand.


The information below relates to Probate where there is a valid will, the assets are in the UK and the matter is not likely to be contested.

In respect of the estate administration, to collect and distribute the assets of the estate. we will provide a a free initial estimate of the amount of work to be conducted and the numbers of hours . on our hourly rates. Our hourly rates are £250 plus VAT.


As a general guide, the legal fees we charge for estate administration can vary in accordance of the complexity of the matter. These can range as follows but are simply a guide:


  1. A low complexity matter £2,000 to £6,500 (excluding VAT and costs)
  2. A medium complexity matter £4,500 to £15,000 (excluding VAT and costs)
  3. A highly complex matter £12,000 to £40,000 (excluding VAT and costs)


Costs (expenses and disbursements)

An expense is a service or goods purchased from a third party by us so that we are able to carry out legal work for you. Expenses will incur VAT. A disbursements is a cost addressed to you as a client. A disbursement will incur VAT, but we will not add VAT if it does not.


Costs in probate and estate administration matters can include bankruptcy searches, advert in the London Gazette, Post in a Local newspaper, valuer's fees for items where the value needs to be established for probate, costs of house clearance or other similar expenses.


In probate applications, a court fee of £273 has to be paid if the value of the estate is more than £5,000.


What we will do


Our fees for probate applications will be to:-


  1. Provide you with a dedicated and experienced solicitors or legal executive to work on your matter
  2. Identify the legally appointed executors or administrators and beneficiaries
  3. Identify the type of probate application you require
  4. Obtain the relevant documents required to make the application
  5. Complete the probate application and the relevant HMRC forms
  6. Make the application to the probate registry on your behalf
  7. Obtain the probate and securely send a copy to you


Our fees for estate administration will be to :


  1. Collect and distribute all assets in the estate


Our fees for probate and estate administration do not include dealing with the sale or transfer of any property in the estate, although we will provide a separate quote or estimate as appropriate if you wish to instruct us to do that for you.


How long will it take


Probate


The time it takes to carry out this work will depend on the complexity of the estate. For example if there is more complicated estate where there are other assets such as investment properties or shares and there is potentially inheritance tax to pay it may take longer than an estate whereby the main asset is the deceased's residence and the estate does not exceed £325,000 being the current threshold for inheritance tax.


However, once we have taken your instructions we will be able to give you an estimate of the amount of time it is likely to take to obtain grant of probate, and if applicable, to then collect and then distribute the assets, and we will keep you informed as the work progresses.


Once probate has been applied for it can take up to 16 weeks for the Probate Registry to process your application.


Administration of Estate


Each person's estate will have a different combination of assets and liabilities, Because of this, the time it takes to complete the administration of estate varies and will be dependent upon the circumstances of the individual.

All our fixed fees include:-


  1. giving you advice about the requirements of the Immigration Rules and whether you meet the criteria
  2. advising you on the evidence required in support and considering it
  3. preparing your application and submitting it on you behalf
  4. preparing any witness statements, if applicable
  5. advising and assisting you throughout
  6. giving you advice about the outcome of the application and any further step you need to take


Disbursements


Disbursements are related to your matter that are payable to third parties, such as visa fees. These will be in addition to the fixed fees stated below.


The following disbursements may be payable:-


  1. Home office/visa application fees/court fees - we will inform you of the cost of these as soon as possible. Please refer to https://www.gov.uk/government/publications/visa-regulations-revised-table/home-office-immigration-and-nationality-fees-24-july-2024
  2. Interpreters Fees - an interpreter maybe required if you do not have a family member or friend available to assist with translation. We will advise you of likely fees if an interpreter is required. These are often charged at hourly rates that can range from whether they are required for full day, half a day or an hour along with travelling time and mileage. Interpreters fees can start from £60 per hour.
  3. Independent expert reports e.g medical experts. These are not required in many cases: we will let you know as soon as possible if we consider an expert report is necessary. Export report fees can vary from £1500 to £2500 depending on the type of report required.
  4. If there is an interview and we do attend with you, there will be additional disbursements in respect of our mileage/travel expenses.


How long will my application take?


We cannot guarantee how long the Home Office will take to process your application. We can however able to check the current Home Office processing times for you at the beginning of your matter to provide you with appropriate timescales.


We estimate that preparing and submitting your application to the Home Office will take between 1 and 6 weeks. This depends on your location and the time it takes you to gather any supporting documentation.

Fixed Fee with No Hidden costs


Our fixed legal fees for motoring offence are set out below when you instruct us, and that means there will be no hidden extra charges added on the end of the transaction  whether this in respect of drink/driving offences, speeding, traffic signal offences, failure to provide driver details offences, no insurance and careless driving.


What we will do


  1. Consider Evidence
  2. Take your instructions
  3. provide advise on the likely sentence
  4. Attendance and representation at a single hearing at the magistrates court.


The fee does not include;-


  1. Instruction of any expert witness
  2. taking statements from any witnesses
  3. advise and assistance in relation to a special reasons hearing
  4. advice or assistance in relation to any appeal


As a guide, if you entered a guilty plea and have a date for your hearing, we can assist you with the following:-


  1. Take your instructions as to what happened
  2. We will consider initial disclosure, any any other evidence and provide advice.
  3. Arrange to take any witness statements of necessary (this will incur an additional cost)
  4. To explain the court procedure to you so you know what to expect on the day of your hearing, and the sentencing options available to the court.
  5. To conduct any further preparatory work, obtain further instructions from you if necessary and answer any follow up queries you have.
  6. We can not however provide a timescale of when your hearing will take place, as this depends on the court listing for that day,
  7. To attend court on the day and meet with you before the court at the anticipated time.
  8. To discuss the outcome with you. If advice is required on appeal, this will carry an additional cost.


Disbursements


 Disbursements are fees payable to third parties. These are in addition to third parties.


In motoring offences, disbursements can include but are not limited to :-


  1. These can include Counsel fees for advice or representation at a hearing. The cost of a barrister depends on their experience and expertise.
  2. Travel Costs - these can include mileage and parking for the solicitor to attend meetings and hearings.
  3. Expert Reports - these can be required in some cases and include medical reports, expert reports on blood alcohol or drug contents, or expert reports on traffic accidents. The costs for such reports can range from £1,000 and £2,000 plus VAT.


How long will my case take to conclude


This will very much depend upon the individual circumstances of the case and as to whether you plead guilty or not guilty at the first appearance or whether further evidence is required to determine the outcome of the matter. This could be from when first instructed to attendance/s at hearing which can take up to 6 to 9 months for the matter to be listed for a trial.
